Do not remove this tag until the deletion nomination is closed. Reason for the nomination: As noted at Commons:Village_pump/Copyright#German_currency, it does not appear that German currency qualifies as an official work. As we know from the stamp review (Commons:WikiProject Public Domain/German stamps review), a German court in relation to stamps clearly said that § 5 Abs. 1 UrhG only applies for literary works (Sprachwerke) and not for works of the visual arts (Werke der bildenden Kunst). In addition, the court's logic about the failure of §5(2) to apply to stamps (see m:Copyright_of_Images_in_German_Postage_Stamps#Official_Works_Exemptions) also applies to currency. This is based on a German Supreme Court test which includes the key point "the official interest is specifically directed at allowing the general public to freely reproduce or otherwise make use of the work that conveys the information.”". This hardly applies to currency! Broadly, legal scholars. doubt that works with purposes other than public dissemination would lose protection under § 5(2). It does not appear that German currency is PD. Therefore all files using this template must be deleted, and the template converted to a speedy-delete template (like {{fair use}}). |
